Care Talent Candidate Agreement

Please review these important terms before signing.

RCCS Is a Third-Party Connection Service

Rosenthal Community Care Services ("RCCS") provides a third-party connection service that may introduce Care Talent Candidates to residential care facilities, care businesses, and other prospective employers.

RCCS is not your employer. RCCS does not hire, employ, schedule, supervise, direct, discipline, compensate, provide payroll for, or provide employee benefits to Care Talent Candidates.

Participation is free for Care Talent Candidates. RCCS may receive a one-time connection or introduction fee from a prospective employer, facility owner, or business owner for facilitating an introduction.

RCCS does not guarantee employment, an interview, wages, hours, scheduling, continued employment, working conditions, or that either party will choose to enter into an employment relationship.

Candidate Profile & Privacy

RCCS may use professional information submitted by you to create a Care Talent profile and advertise, market, or present you to prospective employers through RCCS websites, directories, social media, marketing materials, and direct communications.

If you separately provide RCCS with a profile photograph, you authorize RCCS to display that photograph as part of your public Care Talent profile and related RCCS marketing for the purpose of connecting you with potential employers.

Your direct contact information will not be displayed publicly. Your telephone number, email address, government-issued identification, and other private identifying information will remain non-public.

When a prospective employer requests additional information regarding your profile, RCCS may contact you first to determine whether you remain available and interested.

After you confirm your current availability and interest, RCCS may provide your contact information and/or resume to the prospective employer for the purpose of facilitating an introduction.

Hiring & Employment Relationship

Any interview, hiring decision, employment offer, background or credential verification, compensation, work schedule, supervision, discipline, workplace policies, work assignments, or termination decisions are solely between the prospective employer and the Care Talent Candidate.

Prospective employers remain independently responsible for determining whether a candidate satisfies all employment, licensing, training, background, health, credentialing, and facility-specific requirements applicable to the position.

RCCS does not warrant or guarantee a candidate's performance, conduct, qualifications, continued availability, fitness for a particular position, or continued employment.

RCCS reserves the right to independently determine whether a candidate or participating business remains eligible to participate in RCCS Care Talent Connection Services.

Arbitration Agreement

Except for claims or remedies that cannot lawfully be subject to arbitration, you and RCCS agree that any dispute, claim, or controversy arising out of or relating to RCCS Care Talent Connection Services, this Agreement, an RCCS introduction, or the relationship between you and RCCS will be resolved through binding individual arbitration rather than a court or jury trial.

Covered disputes will be pursued only on an individual basis and not as a class, collective, consolidated, or representative action to the maximum extent permitted by applicable law.

Nothing in this provision prevents either party from pursuing a matter in small claims court when the matter qualifies, seeking legally available temporary or emergency relief, or exercising any right or remedy that applicable law does not permit to be waived or subjected to mandatory arbitration.

Electronic Signature & Technical Audit

By electronically signing and submitting this registration, you consent to conduct this transaction electronically and intend your electronic signature to have the same effect as your handwritten signature.

RCCS may record technical information associated with this submission for authentication, security, fraud prevention, recordkeeping, and verification of the electronic signature.

Technical information may include the submission date and time, browser and user-agent information, device or platform information, browser language, screen dimensions, browser viewport, and time zone.
